The e-commerce website of LEROYDESIGN, a sole proprietorship with registered office at Lange lozannastraat 142; 2018 Antwerp, BTW BE0756854079, offers its customers the opportunity to purchase the products from its webshop online.
These Terms and Conditions ("Terms") apply to any order placed by a visitor to this e-commerce website ("Customer"). When placing an order via the webshop of […], the Customer must expressly accept these Conditions, thereby agreeing to the applicability of these Conditions, to the exclusion of all other conditions. Additional terms and conditions of the Customer are excluded, unless they have been expressly accepted in advance by LEROYDESIGN in writing.
Article 2: Price
All prices stated are expressed in EURO, always including VAT and all other duties or taxes required by the Customer. Orders that are made to measure will always receive their personal calculation and invoice by e-mail.
If delivery, reservation or administrative costs are charged, this will be stated separately.
The price statement refers exclusively to the articles as described verbatim. The accompanying photos are decorative and may contain elements that are not included in the price.
Article 3: Offer
The offer is valid while stocks last and can be modified or withdrawn by LEROYDESIGN at any time. LEROYDESIGN cannot be held responsible for the unavailability of a product. If an offer has a limited period of validity or is made subject to conditions, this will be expressly stated in the offer.
If the Customer has specific questions about, for example, sizes, colour, availability, delivery term or delivery method, we request that the Customer contact our customer service in advance. ( email@example.com)
Article 4: Online purchases
Each product listed on the webshop can be placed in the shopping cart to proceed to sale. After payment, the customer agrees to the terms and conditions and the sale is binding. Your sneakers will then be ordered and personalized immediately upon receipt as shown in the photos or as requested by the customer. This has a delivery time of 2 - 3 weeks. The customer will receive an email with a tracking code.
The Customer can pay securely online with:

LEROYDESIGN is entitled to refuse an order due to a serious failure on the part of the Customer with regard to orders involving the Customer.
Article 5: Delivery and execution of the agreement
The agreement is concluded when the customer pays electronically.
LEROYDESIGN takes appropriate and organizational measures to secure the electronic transfer of data and ensures a safe road environment.
All orders are delivered via Bpost and have a delivery time of 2 - 3 weeks.
All orders delivered in Belgium are shipped free of charge.
An additional delivery charge will be charged for international shipments. This cost is visible in your shopping cart.
For a personal design, after discussion by email, the customer must first pay his invoice for this design before receiving it.
Items ordered through this webshop are delivered in Belgium, the Netherlands, France, Germany, Spain, Italy, Poland, United States, Canada, Korea, Norway, Sweden, Denmark, Malaysia, Indonesia, Singapore.
Additional countries can be added for delivery after contacting customer service. ( firstname.lastname@example.org )
Unless otherwise agreed or expressly provided otherwise, the goods will be delivered to the Customer's place of residence within 30 days of receipt of the order.
This is exceptional if the product (air forces or Jordans,…) is not in stock and has to be ordered.
Any visible damage and/or qualitative shortcoming of an article or other shortcoming with delivery, must be notified by the Customer to LEROYDESIGN without delay.
The risk of loss or damage passes to the Customer as soon as he (or a third party designated by him, who is not the carrier) has taken physical possession of the goods. However, the risk already passes to the Customer upon delivery to the carrier, if the carrier has been instructed by the Customer to transport the goods and this choice was not offered by LEROYDESIGN.
Article 6: Retention of title
The delivered items remain the exclusive property of LEROYDESIGN until full payment by the Customer.
The Customer undertakes, if necessary, to inform third parties of LEROYDESIGN's retention of title, e.g. to anyone who would seize the items not yet fully paid for.
Article 7 - Obligations of the consumer during the reflection period
The consumer can dissolve an agreement with regard to the purchase of a product during a reflection period of 14 days without stating reasons.
During the cooling-off period, the consumer will handle the product and the packaging with care. He will only unpack or use the product to the extent necessary to determine the nature, characteristics and functioning of the product. The basic principle here is that the consumer may only handle and inspect the product as he would be allowed to do in a store. This is, for example, fitting the sneakers indoors and not having worn them outside.
The consumer is only liable for depreciation of the product that is the result of a way of handling the product that goes beyond what is permitted in paragraph 1.
The consumer is responsible for all shipping costs within a return request.
In case of damage to the product ; these are stains, spills, leaving dirt or scratches, compensation will be charged of at least the difference between the purchase price and the sale price. If the customer refuses, LEROYDESIGN may refuse a return.
Article 8: Right of withdrawal
The provisions of this article only apply to Customers who purchase items online from LEROYDESIGN in their capacity as consumers.
The Customer has the right to withdraw from the agreement within a period of 14 calendar days without stating reasons.
The withdrawal period expires 14 calendar days after the day of receipt of the goods.
a) in the case of service contracts or digital content not supplied on a tangible medium: "from the conclusion of the contract for a digital design";
b) for sales contracts (including contracts involving both goods and services): "whereby the Customer or a third party designated by the Customer, who is not the carrier, acquires physical possession of the good.";
c) for contracts where the Customer has ordered several goods in the same order that are delivered separately: "on which the Customer or a third party designated by the Customer, who is not the carrier, takes physical possession of the last good.";
d) for contracts for the delivery of a good consisting of several shipments or parts: "on which the Customer or a third party designated by the Customer, who is not the carrier, acquires physical possession of the last shipment or the last part.";
e) for contracts for regular delivery of goods during a specified period: "on which the Customer or a third party designated by the Customer, who is not the carrier, acquires physical possession of the first good."
To exercise the right of withdrawal, the Customer must inform LEROYDESIGN, email@example.com or 0485/078.204 by email or telephone of his decision to withdraw from the contract. The Customer can use the attached model withdrawal form for this, but is not obliged to do so. This model form can be emailed to the customer if required.
In order to comply with the withdrawal period, the Customer must send his communication regarding his exercise of the right of withdrawal before the withdrawal period has expired.
The Customer must return or hand over the goods to LEROYDESIGN or to KELLY LEROY Heistraat 330, 2610 Wilrijk without undue delay, but in any event no later than 14 calendar days after the day on which he has notified LEROYDESIGN of his decision to withdraw from the contract. The Customer is on time if he returns the goods before the period of 14 calendar days has expired.
The direct costs of returning the goods will be borne by the Customer.
If the returned product is in any way diminished in value, LEROYDESIGN reserves the right to hold the Customer liable and to claim compensation for any loss in value of the goods resulting from the Customer's use of the goods that goes beyond what is necessary to determine the nature, characteristics and functioning of the goods to establish.
In case of damage to the product ; these are stains, spills, leaving dirt or scratches, compensation will be charged of at least the difference between the purchase price and the sale price. The purchase price of sneakers is 110 euros and the purchase price of the material is also charged for this.
Only items that are in the original packaging, together with all accessories, instructions for use and invoice or proof of purchase can be returned.
"If the Customer has requested that the provision of services be started during the withdrawal period, the Customer will pay an amount that is proportional to what has already been delivered at the time of notifying us that he cancels the contract, compared to the full implementation of the agreement.”
If the Customer withdraws from the contract, LEROYDESIGN will refund to the Customer all payments received from the Customer up to that point, excluding the standard delivery charges, within a maximum of 14 calendar days after LEROYDESIGN has been notified of the Customer's decision to cancel the contract. revoke. In the case of sales contracts, LEROYDESIGN may withhold reimbursement until it has received all the goods back, or until the Customer has demonstrated that he has returned the goods, whichever comes first.
Any additional costs resulting from the Customer's choice of a delivery method other than the cheapest standard delivery offered by LEROYDESIGN will not be refunded.
LEROYDESIGN will refund the Customer with the same payment method with which the Customer made the original transaction, unless the Customer has expressly agreed otherwise; in any case, the Customer will not be charged for such reimbursement.
The Customer cannot exercise the right of withdrawal for:
service agreements after the full performance of the service. (custom sneakers that are made to measure)
Products made to customer specifications. These are sneakers that are custom made. Products purchased on the web shop with a request for additional adjustments or therefore additional specifications also apply under these conditions; such as the customer's initials or a name. This can also be extra colors or extra drawings.
In case of damage to the product ; these are stains, spills, leaving dirt or scratches, compensation will be charged of at least the difference between the purchase price and the sale price.
the delivery of digital content that is not delivered on a tangible medium, if the execution has started with the express prior consent of the Customer and provided the Customer has acknowledged that he loses his right of withdrawal (e.g. Digital design);
Article 9: Warranty
Under the law of 21 September 2004 on the protection of consumers in the sale of consumer goods, the consumer has legal rights. This legal guarantee applies from the date of delivery to the first owner. Any commercial warranty does not affect these rights.
To invoke the warranty, the Customer must be able to present proof of purchase. Customers are advised to keep the original packaging of the goods.
For items purchased online and delivered to the Customer's home, the Customer must contact LEROYDESIGN customer service and return the item to LEROYDESIGN at its expense.
If a defect is found, the Customer must inform LEROYDESIGN as soon as possible. In any case, any defect must be reported by the Customer within a period of 2 months after its discovery. Afterwards, any right to repair lapses.
The (commercial and/or legal) warranty never applies to defects that arise as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, non-compliance with the general conditions for care for the product, modifications or changes to the item, heavy-handed use, poor maintenance, or any other abnormal or incorrect use.
The customer is therefore not entitled to an exchange and can under no circumstances request a refund.

Article 11: Sanctions for non-payment
Without prejudice to the exercise of other rights available to LEROYDESIGN, in the event of non-payment or late payment from the date of default, the Customer will owe an interest of 10% per year on the unpaid amount by operation of law and without notice. In addition, by operation of law and without notice, the Customer owes a lump-sum compensation of 10% of the amount concerned, with a maximum of minimum of 25 euros per invoice.
Without prejudice to the foregoing, LEROYDESIGN reserves the right to take back the items not (fully) paid for.
Article 12: Privacy
The data controller, LEROYDESIGN, respects the Belgian law of 8 December 1992 regarding the protection of privacy in the processing of personal data.
The personal data provided by you will only be used for the following purposes: the execution of the concluded agreement, processing the order, sending newsletters or advertising and / or marketing purposes.
You have a legal right to access and possibly correct your personal data. Provided proof of identity (copy of identity card) you can obtain the written communication of your personal data free of charge by means of a written, dated and signed request to LEROYDESIGN ( email@example.com ). If necessary, you can also ask to correct the data that would be incorrect, incomplete or irrelevant.

We treat your data as confidential information and will not pass it on, rent or sell it to third parties.
The customer is responsible for keeping his login details and the use of his password confidential. Your password is stored encrypted, so LEROYDESIGN has no access to your password.
LEROYDESIGN keeps online (anonymous) visitor statistics in order to see which pages of the website are visited and to what extent.

Failure at any time by LEROYDESIGN to enforce or exercise any of the rights listed in these Terms shall never be deemed a waiver of such provision and shall never affect the validity of those rights.
Article 15: Change of conditions
These Terms and Conditions are supplemented by other terms and conditions explicitly referred to, and the LERYDESIGN general terms and conditions of sale. In the event of any contradiction, these Terms and Conditions shall prevail.
Article 16: Evidence
The Customer accepts that electronic communications and backups can serve as evidence.
Article 17: Applicable law – Disputes
Belgian law applies, with the exception of the provisions of private international law regarding applicable law.
The courts of the Consumer's place of residence have jurisdiction in legal disputes. The Consumer can also contact the ODR platform (http://ec.europa.eu/consumers/odr/).
